How to get your Health and Safety Certificate
Health and Safety Compliance Certification
Each business and subsequent employer in South Africa must be compliant with the Occupational Health and Safety Act 85 of 1993. However, to verify Health and Safety Compliance, a Health and Safety Audit must be conducted by a SAIOSH Authorised Health and Safety Company, if the Audit passes all requirements then a Health and Safety Compliance Certificate will be issued.
It is for this purpose that the sections below indicate how you can get your health and safety certificate, as many employers may be unfamiliar with the process involved, or what the true value of such a certificate is.
The OHS Act and many other great Health and Safety Solutions are available on our E-commerce platform My Safety Shop.
What is the Health and Safety Compliance Certificate?
One of the best ways in which employers can ensure that they are OHS Act compliant is by having a health and safety compliance audit conducted by SafetyWallet. Once the subscriber has joined, they can request that a SafetyWallet auditor conduct the audit, in which their level of compliance and the effectiveness of their OHS program will be determined.
Once the audit is completed and the subscriber is found competent with the requirements set out in the Occupational Health and Safety Act 85 of 1993, they are provided with a Health and Safety Compliance Certificate. This certificate is valid for a year and will be reissued once the subscriber has booked their next OHS compliance audit.
Our Safety Compliance Audit goes beyond ticking boxes. It's a comprehensive examination of your workplace, identifying potential risks and areas for improvement. This audit is your roadmap to a safer, more compliant workplace. The Compliance audit looks at the following matters amongst others:
- Hazard Identification and Risk Assessment Practices
- Health and Safety Appointments and Structure in the Workplace
- Health and Safety Training Requirements
- Hazardous Chemicals and Biological Agents in the Workplace
- Building and Infrastructure Safety
- Emergency Preparedness in the Workplace
- Health Surveys and Medical Surveillance
- Personal Protective Equipment
- Health and Safety inspections
- Health and Safety Administration
- Health and Safety Responsibilities regarding IOD's and Compensation for Occupational Diseases and Injuries in the workplace
- Machinery and Equipment
- Contractor management
Why is the Health and Safety Compliance Certificate important?
In having obtained a health and safety compliance certificate, employers are much better equipped when they are inspected by the Department of Employment and Labour, the Fire Department, the Department of Higher Education and Training, and numerous others as well as complying with Tenders and Vender criteria.
The certificate verifies the employer’s compliance with OHSA and would assist them of any penalties, fines, and even possible imprisonment.
Even though audits are not a legal obligation, employers have a legal obligation towards providing a work environment that is safe, healthy, and free of harm. The best way in which this can be ensured is by having a compliance audit done.
Non-compliance with OHSA may result in severe penalties where the employer, business owner, or director could face fines of up to R100,000.00 or up to 2 years in prison, or both.
How can employers obtain their Health and Safety Compliance Certificate?
The HSE compliance certificate is issued after a site inspection of the work premises has been conducted by qualified auditors from external establishments such as SafetyWallet. The auditor will inspect the workplace for hazards and risks, assess the safety control measures in place, identify areas of concern, and make recommendations.
Employers can ensure that this process is made easy and hassle-free by subscribing to SafetyWallet and ensure that they are on the road to continuous compliance by making use of SafetyWallet's all-encompassing solutions.
With SafetyWallet, subscribers are provided with an audit team of professionals who have the necessary skills and qualifications to help them identify key areas where improvements are needed, highlight strengths, and put together an action plan to ensure that effective controls are in place.

2021-06-11 12:36:30Daniel Retief Each business and subsequent employer in South Africa must be compliant with the Occupational Health and Safety Act 85 of 1993. However, to be proven compliant, a Certificate of Compliance (COC) must be issued. This is false marketing and a downright blatant lie as the OHSA does not require a coc for OHSA compliance to be issued. The only coc's issued in terms of the OHSA and Regs are for electrical and gas installations. 2021-04-05 13:54:57 Any reaction on this comment??
2023-06-05 08:02:58Dear Johann Thank you for your comment... Daniel was referring to the original post content, we have since changed the content... The bottom line is: what cannot be measured, does not exist... No-where in the OHS Act does it say that a Health and Safety Certificate must be issued, it is therefore common practice to have your business audited to verify compliance, in doing so you would naturally want proof, and this is the Health and Safety Compliance Certificate. You need this for Tenders and schools must also submit this to Dept of Higher Education. Hopefully I have added value to the understanding of the Health and Safety Compliance Certificate.

2021-11-30 09:42:35The recent cases of children experiencing food poisoning has raised issues re providing food to children. I work at an NPO where our staff make sandwiches for children. The children who visit our NPO attend for healing re sexual and physical abuse. In most cases these children are from the rural areas and are hungry, so the NPO provides some nourishment. When a child is hungry it is difficult to get their full attention and/or alertness. There are times when we go out for holiday programmes or give year-end parties: what are the health and safety requirements to adhere to re providing snacks, food, etc? In some instances, private sponsors prepare food for our children's events. Are their issues here too? Generally, does the NOPO require a health certificate to make its own internal snacks etc?
2024-10-23 08:57:44Good day Dante To address your questions regarding health and safety requirements for providing snacks and food, especially in the context of children's events and private sponsors, several key considerations must be taken into account. Here’s a breakdown of the relevant health and safety requirements: General Health and Safety Requirements for Food Provision Food Safety Regulations: Ensure compliance with the Foodstuffs, Cosmetics and Disinfectants Act (Act No. 54 of 1972) which governs the safety and hygiene of food products. Food must be prepared, stored, and served in a manner that prevents contamination and ensures safety. Health Certificates: Individuals or organizations preparing food for public consumption may be required to have a health certificate or food handling certificate, especially if they are providing food at events. This ensures that those preparing the food are trained in safe food handling practices. Hygiene Standards: All food preparation areas must adhere to strict hygiene standards, including cleanliness of surfaces, proper storage of ingredients, and personal hygiene of food handlers. Regular inspections may be required to ensure compliance with hygiene standards. Allergen Management: Clear labeling of food items is essential, especially for allergens (e.g., nuts, gluten, dairy) to protect children with food allergies. Staff should be trained to handle allergen-related inquiries and emergencies. Temperature Control: Foods must be kept at safe temperatures to prevent the growth of harmful bacteria. This includes proper refrigeration of perishable items and maintaining hot foods at safe serving temperatures. Specific Considerations for Private Sponsors Sponsorship Agreements: Ensure that any agreements with private sponsors include clauses that require compliance with health and safety regulations. Sponsors should provide proof of compliance, such as health certificates or food safety training documentation. Liability and Insurance: Consider liability issues related to food safety. Ensure that sponsors have appropriate insurance coverage in case of foodborne illnesses or allergic reactions. Event Planning: Conduct risk assessments for food-related activities at events, considering factors such as the number of attendees, types of food served, and potential allergen exposure. Internal Snack Preparation by NOPO Health Certificates: If the NOPO (Non-Profit Organization) intends to prepare its own snacks, it may be required to obtain health certificates for the individuals involved in food preparation. Compliance with local health department regulations is essential. Training: Staff involved in food preparation should receive training in food safety and hygiene practices to ensure compliance with health regulations. Documentation: Maintain records of food safety training, health certificates, and any inspections conducted by local health authorities. In summary, it is crucial to adhere to food safety regulations, ensure proper training and certification for food handlers, and maintain high hygiene standards when providing snacks and food, especially for children's events. If private sponsors are involved, ensure they comply with the same standards and have the necessary documentation. For internal snack preparation, obtaining health certificates and training staff is essential to ensure safety and compliance. For specific local regulations or additional guidance, it may be beneficial to consult with your local health department or a health and safety professional.

2021-05-19 09:01:26How does one remain anonymous to report something
2024-07-07 08:58:07Hi Ben In this case the best thing to do, would be to contact the Department of Employment and Labour. The Department of Employment and Labour is responsible for enforcing the Occupational Health and Safety Act. You can report non-compliance to them.
